Delaware - Update 2009

A recent bill in Delaware is House Bill 40, if passed the new law would:

Enhances driving safety by establishing distracted driving standards and allowing mobile telephones to be used while operating a moving motor vehicle only when equipped with built-in speakers or a hands-free accessory, to prohibit placing or receiving text messages, sending or receiving e-mails on mobile telephones or other electronic devices, to require the State Police Department to include on motor vehicle accident reports information about the use of mobile telephones or other distractions by drivers.

The bill is currently (Late 2009) pending carryover in the Senate.

Delaware Driving and Cell-Phone Legislation

The State of Delaware has regulations regarding the use of cellular phones while driving. While Delaware driving laws do not include hands-free legislation, they do address driving and cell-phone use by minors and by operators of a school bus. Delaware House bill 63 amends Title 21 of the Delaware code and prohibits drivers under the age of 18, using a Level "1" learner's permit from using a cellular device or any type of hand-held communication device while operating a motor vehicle.

If a minor is caught using a mobile communication device while driving, they will receive a one month suspension of their drivers license for the first offense. For subsequent offenses, drivers that violate the Delaware cell-phone legislation will have their drivers license suspended for three months.

Like many cell-phone laws across the United States, there are exceptions for emergency situations. There is a $25 reinstatement fee for drivers that have had their license suspended for violating the State of Delaware cell-phone law.
