Delaware Driving and Cell-Phone LegislationThe State of Delaware has regulations regarding the use of cellular phones while driving. While Delaware driving laws do not include hands-free legislation, they do address driving and cell-phone use by minors and by operators of a school bus. Delaware House bill 63 amends Title 21 of the Delaware code and prohibits drivers under the age of 18, using a Level "1" learner's permit from using a cellular device or any type of hand-held communication device while operating a motor vehicle. If a minor is caught using a mobile communication device while driving, they will receive a one month suspension of their drivers license for the first offense. For subsequent offenses, drivers that violate the Delaware cell-phone legislation will have their drivers license suspended for three months. Like many cell-phone laws across the United States, there are exceptions for emergency situations. There is a $25 reinstatement fee for drivers that have had their license suspended for violating the State of Delaware cell-phone law.
