What is a DUI hardship license?

Answer:

A DUI hardship license is intended to help you keep your job or continue your education after a DUI suspension. Sometimes and under some circumstances, you may be able to apply for a hardship license allowing you to drive on a conditional basis so that you can continue to work.  DUI laws are very different in different states and so is the ability to get a hardship license.  Depending on the state you live, these licenses may be known as limited license, work license, Cinderella license or day license.

The procedure for getting a hardship license may be different as well but there will be some criteria that are fairly uniform:

  • This should be your first DUI – subsequent offenses will probably make such licenses impossible;
  • Your driving record aside from this offense should be acceptable;
  • A mandatory ignition interlock device will be installed;
  • You will be required to attend driver safety course;
  • You may be required to attend alcohol classes;
  • You may be required to report to a probation officer.

The hardship license is not easily obtained.  You may have to produce any or all of the following documents:

  • A letter from your employer on company letterhead stating your work hours and that you need to drive in order to get to work;
  • Maps showing your route to work;
  • Proof that there is no public transportation availability;
  • Proof of enrollment in an alcohol education program;
  • You must bring proof that you have passed the written test;

The hardship licenses are intended for you to be able to go to work, school, alcohol class and many states restrict you to only those activities – even stopping at the grocery store may be prohibited in your state. These licenses are difficult to obtain and you will need an experienced attorney to assist you.
