Another defense is that you weren’t drunk, but suffered from allergies or lack of sleep, according to Nolo. You may also challenge the accuracy of the blood alcohol content (BAC) test.

Another DUI defense is that there was no probable cause to arrest you. This defense can be used when the arresting officer didn’t have a reason to stop your vehicle you were driving erratically or appeared intoxicated. Instead the arresting office stopped you for a reason such as ethnicity or race.
