Ohio DUI laws impose strict penalties on those who have been found to be driving over the legal limit. The penalties become progressively worse if you have already committed a DUI offense within the six years prior to the offense you are currently being charged for. Some of the potential penalties for a second DUI conviction within six years in Ohio include:
  • Being charged with a first degree misdemeanor, which will appear on your criminal record
  • A minimum of either ten days of incarceration or five days of incarceration combined with eighteen days of house arrest or alcohol monitoring. The amount of time you can spend in jail is up to six months maximum
  • A fine ranging between $525 and $1625
  • Mandated drug and alcohol assessment and a requirement to complete any programs recommended based on the assessment
  • A license suspension for between one and five years 
  • A special DUI license plate and an ignition interlock device that tests your BAC before you can start your car, if your DUI was for driving drunk as opposed to under the influence of another drug. 

The penalties become even worse if you test high on the BAC scale, and include a minimum of 20 days of incarceration and 36 days of house arrest.
