In the State of Illinois, driving under the influence with a blood alcohol content (BAC) of .08 percent is a criminal violation. Illinois follows the federal "per se" rule which is used nationwide. Additionally, Illinois is a "zero tolerance" state. Therefore, if you are under 21 years of age and are driving with a BAC of .02 or higher, you may incur additional penalties. Commercial vehicle drivers violate the law when driving with a BAC of .04 or higher. Illinois provides exceptions to those who consume alcohol as part of a religious ceremony or who take medicine that contains alcohol.

Illinois is also an "implied consent" state. This means that if you drive in the State of Illinois, you have implicitly agreed to submit to a chemical test your blood, breath or urine. If you refuse to submit to a chemical test, you may be subject to additional penalties.

If you are convicted for a first-time DUI violation in Illinois, you will incur a minimum 1-year suspension of your drivers license. Additionally, you may be imprisoned for up to one year and fined up to $2,500. If you had a minor under the age of 16 in the vehicle at the time of the violation, you may also be subject to an additional minimum fine of $1,000 as well as 25 days of community service.

A second DUI offense mandates a 5-year suspension of your license. A third conviction incurs a 10-year loss of your driving privileges.

Other penalties include vehicle registration suspension and possible installation of a Breath Alcohol Ignition Interlock Device which requires you to submit to a breath test before you can start your vehicle.
