Question:

I'm a truck driver. Can I lose my license for drunk driving in Massachusetts?

Answer:

DUI laws in Massachusetts provide stiff penalties for truck drivers and commercial driver’s license holders (CDL) who are convicted for drunken driving offenses and breathalyzer refusals. Under the Massachusetts DUI laws and the Federal DOT regulations, truck drivers and CDL holders who are convicted for a first offense DUI, will have their license suspended for a minimum of one year. A second offense results in a lifetime revocation and disqualification of your CDL. It does not matter if the DUI offense occurred in a commercial or passenger vehicle or out of the State of Massachusetts, the same penalties and laws apply. The Massachusetts Registry of Motor Vehicle has a zero tolerance to DUI CDL suspensions. You cannot obtain a hardship license. The only option you may have is to appeal to the Division of Insurance, Board of Appeal and present your case. They have the power in some cases to reinstate a CDL even if there has been a lifetime revocation and disqualification. The violations will automatically appear on your driving record in Massachusetts and may affect employment hiring.

If a truck driver or CDL holder is convicted of a DUI offense in Massachusetts, they face suspension or permanent loss of their license. Hiring the right attorney is crucial to your defense. You should consult with a Massachusetts DUI defense attorney to find out what defenses are available to you. The attorney will explain the Massachusetts DUI CDL laws to you. The DUI defense attorney is an expert at defending DUI CDL cases and will be able to handle your case properly.
