What are the consequences for a first DWI in Colorado?

In Colorado, like in most states, there are penalties associated with driving while impaired by alcohol or other drugs. If you have a BAC above .08, or if you are otherwise driving while under the influence with impaired faculties, you will face a myriad of serious penalties. The exact nature of the penalties you face are going to vary depending on the circumstances surrounding your arrest and on whether the offense is a first or if you've been arrested before. 

The penalty for first colorado DWI include:

  • An administrative license suspension of 9 months if you have a BAC of above .08  (because this is an administrative penalty, it is automatic)
  • Jail time of a minimum of 2 days if you are charged with DWAI (driving while alcohol impaired) or a minimum of 5 days if you are DWI. The jail time could extend for up to 1 year in either instance, at the discretion of the judge and depending on aggravating factors
  • Fines of $200 to $500 for a DWAI or of $600 to $1000 for a DUI
  • Community Service of 24-28 hours for a DWAI or 48 to 96 hours for a DUI

There may also be other applicable penalties as well, including a requirement that you attend drug or alcohol counseling, or a requirement that you attend victim impact panels. The judge ultimately has a great deal of discretion, as long as he remains within the statutory limits.
