DUI laws in Colorado for minors are very strict.  Those drivers over 21 can face a DUI or DWI for .08 or less BAC.  For those persons under 21, Colorado has a “zero tolerance” law which carries serious penalties for a BAC of .02 or more.

Under the law, if you have a BAC of .02 or more you will face:

  • Mandatory suspension of license for one year;
  • Community service;
  • Fines; and,
  • Alcohol education classes.

If you are under 21, and even for a first offense, your car can be impounded and you can:

  • Be driven to jail in handcuffs;
  • Be asked to provide a blood sample or other test for BAC;
  • Fingerprinted and photographed; and,
  • Put in a jail cell.

You will also undoubted be asked to carry more expensive insurance once your license is reinstated.  In addition, if there was an accident with injuries or death, the underage drinker can be charged with vehicular assault or homicide both of which carry hefty prison sentences.
