Being charged with a first offense DUI in the state of Kentucky can result in swift and severe penalties, but these penalties increase significantly if you’re charged again with the same offense. Kentucky, as with many states, increases the penalties for a 2nd offense DUI. Under Kentucky DUI laws penalties the penalties include but may not be limited to the following:

  • For a second offense DUI conviction, your required alcohol and/or drug treatment program will be increased from 90 days to a full year
  • Your possible jail time will also be increased, and will range anywhere from one week up to a half a year.
  • Your license will be suspended but, rather than a month to four months as for a first offense, the term will range from a full year to a year and a half.
  • You may also be ordered to serve in a community service program, for anywhere from 10 full (8 hour) days to 6 full months worth.
  • The citation you may receive for your second offense DUI conviction increases in its minimum only, from $250 dollars to $350 dollars. The maximum remains at $500 dollars.

As with any DUI conviction, these penalties can increase exponentially if you are charged with an aggravated DUI, meaning your blood alcohol content was excessively high or you injured another person as a result of your offense.
