Question:

I was cited for a moving violation. Can I get it removed from my record?

Answer:

If you’ve received a citation for any kind of moving violation that’s been applied to your state record, it could affect your ability to obtain certain kinds of licenses, like a Commercial Driver’s License, or to obtain jobs that require a clean driving record. Because of this, it’s important you contact the DMV office wherever the offense occurred to find out how to remove the points from your license. Having the points on your license taken care of is required for having a moving violation removed from your record.

  • If you received a violation that is considered municipal, appear at the date specified, even if the appearance has been checked as “not mandatory” and ask for the municipal judge to approve the violation being removed from your record if you either attend a traffic class or go a certain amount of time (determined by the court) without receiving another citation.
  • In some cases, you may be required to do both in order to have a moving violation removed from your driving record.
  • Any moving violation that is considered a criminal offense may never disappear from your record without the stipulation being entered by the circuit court judge at the time of your sentencing.

To get a violation removed from your record, it is a good idea to hire an attorney. Your lawyer can help you petition the court or take the appropriate steps to have the violation removed.
