Question:

What can I do if I was incorrectly issued a speeding ticket?

Answer:

If you were issued a speeding ticket, and you feel that you were wrongly accused, you can question the ticket in a court of law.  During the challenging of a speeding ticket, you don't just send in your fine- instead, you plead your case to the court and see if you can be successful with your challenge.

To argue that you were incorrectly issued a speeding ticket, you can make any one of a number of arguments:

  • You can argue that you were unable to keep to the posted speed limit due to an imminent emergency.  For example, speeding to get a laboring wife to the hospital or because you have chest pains and need medical attention can be an argument against a speeding ticket.
  • You can argue that given the circumstances of the weather, the road conditions, and traffic patterns, that the police officer in your case had no way of accurately assessing your speed at the time the ticket was issued.
  • You can argue that you had to maintain that higher speed to avoid getting into an accident.  You will need to prove some imminent risk, such as a collision, to make this argument.
  • You can argue that in your state, your posted speed limit is not typically enforced to the letter, and that you were only within 5-10 miles over that limit.  This argument works only in some states and situations.

If you want to challenge a speeding ticket, it can be helpful to have a lawyer on your side. Your attorney can assist you in developing a strong case that your speeding ticket was not given properly, so you'll have a better chance of walking away from the situation without a fine or penalty.
