Drinking under the influence is a serious crime. It will involve a series of court proceedings and, in most cases, the suspension of your driver’s license. Having your license reinstated can be a lengthy process, and it may not always be possible to get your DUI drivers license reinstated immediately. However, there are steps you can take to get your license back after a DUI. 

Getting Your License Back After a DUI

The laws and regulations issued by Motor Vehicle Agencies and criminal courts will vary depending on state so it is important to be familiar with your state’s rules and laws. In most states, a license suspension is automatic after a DUI and begins immediately upon your request. You may be able to petition the DMV to get the license suspension lifted right away, in some states, but in others, you will have to wait a set period of time before you can get your license back and you will have to comply with certain requirements.  In Florida for instance, if you wait until you revocation period ends before you apply for your license to be reinstated, you will be required to present proof of completion of a DUI school or treatment program.  

While the rules do vary, to get your license back and remove a license suspension after a DUI, there are some common requirements most states have. For example, you must:

  • First, complete all programs assigned to you by the judge. Most likely, the judge will recommend you attend alcohol awareness programs. Attending and completing the programs and counseling sessions is mandatory for you to get your license back. 
  • Speak with your insurance agent and ask about the SR-22 form. If your state requires it, fill out the form and submit it to the DMV or Secretary of State. 
  • Attend a driver’s license hearing to prove you have completed all requirements and to request reinstatement.
  • Pay the reinstatement fee. Again, this will vary depending on state so you will have to ask the DMV or the Secretary of State’s office about it. The fee must be paid for you to get your license.  
  • Avoid any form of trouble during the waiting period. In some cases, you may be offered a restricted license to get to and from work before your license privileges are fully reinstated. If you get a ticket during the restricted period, you may risk having your driver’s license revoked or having to wait longer to get your license reinstated.
