Two Ways Georgia Will Convict on a DUI

In Georgia,there are two ways you can be convicted of DUI.  The first is called driving less safe.  That means the State will try to prove that you were less safe than you would have been had you not consumed drugs or alcohol.  This is proven by field sobriety evaluations.  Most officers have video cameras in their cars and the State will use the video to try to show you were less safe.  In addition, they will attempt prove you were less safe through physical manifestations of insobriety. That is slurred speech, flushed complexion, and etc. Videos often are very effective in showing just the opposite-that our client was in fact safe to drive. 

The second way the State will try and get a conviction is called a "per se" DUI.  That is, either you blew over tyhe legal limit or were driving with an illegal drug in your system.  It doesn't matter if you were safe to drive or not under this DUI, thus the designation "per se".
