A CDL speeding ticket presents a special headache for drivers since it is actually harder to contest. A driver with a regular license is not held to as high of standards as drivers with a CDL. The reason for this is actually pretty sound since the requirements for a CDL are far more strict and rigid.

CDL Endorsements

Many feel that with a CDL endorsement, one can fight a speeding ticket. An endorsement is simply additional training after receiving the CDL in order to drive more specialized trucks like ones that haul hazardous material. This does not help in contesting a speeding ticket. An endorsement just means that the driver has passed additional tests and examinations. For example, commercial bus drivers will need training to deal with unruly passengers and basic emergency procedures. This does not mean they will be better equipped to contest tickets.

How Can I Fight?

You will need to look at other ways to contest the ticket. While it won’t make the ticket go away, you may still want to think about driving school because it will reduce penalty points against your license. Many states charge more points per violation to holders of a CDL and you certainly do not want to risk your livelihood if there is a way to keep your license. First, make sure that it’s even worth fighting.  Some states have what is called presumed speed limits which mean that under good weather and traffic conditions your speed can go a few miles above what is posted. If this is the case, you will need to prove that the conditions were as such to the judge. Other states use an absolute speed limit where going above the speed limit by one mile per hour is enough for a ticket and there is little you can do to contest it.

With a Little Help from a Lawyer

A lawyer will be able to tell you if you live in a presumed or absolute speed limit state. The lawyer will also be able to obtain copies of the policeman’s notes and even request reports on the radar gun if one was used. A common argument is that the radar gun was faulty or inaccurate due to outside forces. If the gun had to go through signs, posts, or other cars, the reading can be wrong. The lawyer will be able to get pictures of any possible obstacles to show to the judge. While a CDL endorsement will not necessarily save you from a speeding ticket, a lawyer should be able to at least reduce the fine, especially if the ticket was given unjustly.
